Nevada GOP says honor those who died in battle by killing background check bill

The Nevada Republican Party early Saturday morning added to the chorus of dissenters to state Sen. Justin Jonss' background checks bill.

This has become a partisan issue in Carson City, as it did in DC, with several groups sending out breathless alerts and posting apocalyptic messages.

The state GOP arguing folks "need to ask you to take some action this weekend to honor the sacrifices our fallen service members made to defend our rights, including the right to keep and bear arms."

Really?

Citizen Legislative Action Alert

 

We hope that your Memorial Day weekend is off to a great start. Unfortunately, the Nevada Legislature never rests at this point in the session, and we need to ask you to take some action this weekend to honor the sacrifices our fallen service members made to defend our rights, including the right to keep and bear arms.

The Nevada Legislature is moving quickly on legislation that will unjustly interfere with the Right to Keep and Bear Arms, and will be holding a hearing first thing Tuesday morning to approve Universal Background Checks for firearm transfers in Nevada, including most private transfers between individuals.

A group of conservative grass roots Nevadans has become seriously concerned that SB221 will pass the Legislature and become law. This bill already passed the Senate this Wednesday, and will be heard before the Assembly Judiciary Committee on Tuesday, May 28th, at 8:00 am. WE are asking for grassroots email, fax, and especially, phone support to pressure the Nevada Legislature from passing this bill into law.

Why is this bill so bad?

1) Section 7.9 establishes that if you transfer a firearm in Nevada without the required background checks, that you will lose your right to possess firearms for two years. It is obvious that this constitutes cruel and unusual punishment. If you forget to register your vehicle, you are fined $1,000 but you do not lose your vehicle or right to drive. If you get a D.U.I., your license is suspended for 90 days the first time and one year the second time, but they don't forbid you to own a car. This section is quite obviously biased against firearms owners.

2) Criminals that seek to illegally sell or buy firearms will not follow this law. We are therefore creating a large burden on private citizens to inhibit the free exercise of their Second Amendment rights with no hope of actually deterring or preventing crime.

3) This law also requires a record of the transaction which then becomes a record of ownership. Records of ownership can lead to confiscation. While the informed among us know that mass confiscation of legally-owned firearms seemed unimaginable and unconstitutional, in has in fact happened:

4) In certain situations, where a transfer cannot be completed because a buyer backs out or is found to be a prohibited person, the FFL dealer may be required to perform a background check on the seller before they can return their own gun to them!

5) The wording of the bill can be construed to require FFL dealers to perform transactions that they may not want to handle due to financial and liability concerns. It’s inappropriate for the government to dictate to independent small businesses what transactions they’ll perform.

 

ACTION REQUEST:

 

1) Please fax and /or call members of the Nevada Assembly Judiciary Committee and urge them to not pass this bill. If you can do nothing else, please email your opinion to them. However, we're told that emails only are not holding the sway they did as the legislative session is near the end and legislators don't have time to read emails

 

2) Please forward the link for this alert to everyone you think might be interested in it. Post it on Facebook, Twitter and send it to your email lists!

 

3) Be prepared to attend the Assembly Judiciary Committee hearing on SB 221 on Tuesday morning at 8:00. A large appearance in person at the hearing has succeeded before in deterring the passing of similar un-American legislation. Even if we are not successful in stopping the bill in committee, our presence is critical to tell our side of the story and prove that the people oppose this bill.

 

4) Stay tuned – If the Assembly Judiciary passes this legislation out of their committee, we then must communicate to the entire Assembly not to pass it. Lastly, if the Legislature passes this bill, we will look to Nevada Governor Sandoval to exercise his Veto powers. Please do not bother the governor's staff with this issue until, and if, the Legislature passes the bill. His office is swamped with other issues and his staff simply won't have time to address a moot point on a bill not on his desk. “Keep your powder dry” until it is needed.
